THIS SWEEPSTAKES IS OFFERED ONLY IN THE FORTY-EIGHT (48) CONTIGUOUS STATES OF THE U.S. AND D.C. (EXCLUDING ALASKA, HAWAII, PUERTO RICO, ALL U.S. TERRITORIES AND POSSESSIONS, AND ALL OVERSEAS MILITARY INSTALLATIONS) AND IS INTENDED FOR PARTICIPATION IN THOSE AREAS ONLY. Sweepstakes Description: "MONDRINA" Sweepstakes (“Sweepstakes”) begins as of 12:00 a.m. Pacific Standard Time ("PST") on Tuesday May 29, 2012, , and ends as of 12:00 p.m. PST on Friday, June 29, 2012. (“Sweepstakes Period”). For purposes of this Sweepstakes, all times refer to PST. The only way to enter this Sweepstakes is by using the Internet as described below. How to Enter: No purchase necessary for a chance to win. To enter, access the Contest section at Handbago.com (“Website”). If you are a Handbago member, enter your Username and Password and click on “Click to Enter”. You may then be asked to complete the entry form with items such as your complete address, home telephone number (including area code) and date of birth and click on “Click to Enter” to receive one (1) entry into the Sweepstakes (“Entry”). If you are not a Handbago member, complete and thereafter transmit the entry form by clicking on “Click to Enter” to receive one (1) Entry into the Sweepstakes. Information required on the non-member Entry form (collectively “Entry Information”) may consists of items such as your complete first and last name, complete street address (including city, state and zip code), home telephone number (including area code), date of birth, e-mail address and e-mail address confirmation. You will also have the opportunity to become a Handbago Member by clicking on “Become a Handbago Member!”. Becoming a Handbago member is not required to enter the Sweepstakes and will not increase your chances of winning. If a potential entrant is a resident of a jurisdiction that deems him/her to be a minor, s/he must obtain parental/legal guardian consent prior to entering Sweepstakes or submitting any personally identifiable information or becoming a Handbago member. Limit one (1) Entry per person, per e-mail address, per household for the entire Sweepstakes Period. Entries in 12:00 p.m. PST on Friday, June 29, 2012. All required Entry Information must be completed in full. Any attempted form of Entry other than as described herein is void. Eligibility: This Sweepstakes is only open to permanent legal residents of the forty-eight (48) contiguous states of the U.S. and the District of Columbia, who are physically located and residing therein (excluding Alaska, Hawaii, Guam, Puerto Rico and all other U.S. and foreign territories and possessions and all Overseas Military Installations), who are eighteen (18) years of age or older as of Friday, June 29, 2012 who had Internet access on or before Friday, June 29, 2012. Employees of Handbago (“Sponsor”) and/or Partner Companies and those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers, any other person or entity associated with the Sweepstakes (collectively “Sweepstakes Entities”) and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not legally related, are ineligible to enter or win the Sweepstakes. Sponsor and Sweepstakes administrator reserve the right to verify eligibility of all entrants. Prizes include: One (1) Mondrina Neveah Envelope Clutch in Fairy Dust ARV $240. Total ARV for the prize pack is two hundred and forty dollars ($240). Odds of winning a Prize depends on the total number of eligible Entries received during the Sweepstakes Period. Additional Prize conditions, limitations and restrictions may apply. Winners are solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included, including but not limited to any required installation or requested product upgrades/options/extended warranties. Winner (if a resident of a jurisdiction that deems the winner to be a minor, his/her parent or legal/guardian) will be responsible for any additional costs and incidentals associated with the prize. Winners will be mailed their respective prize pack at the address provided by email or entered on the entry form no later than one month (30 days) from the end of the contest. If delivery is returned, prize will be forfeited and no additional compensation will be awarded in Sponsor’s sole discretion, and prize packs will not be awarded to an alternate winner in accordance with this Sweepstakes Official Rules. Sweepstakes Entities are not responsible for delays in delivery of a Prize (or Prize components). All other expenses and items not specifically mentioned in these Official Rules are not included and are each winner’s sole responsibility. Prizes (or Prize components) may not be exchanged. No transfer, substitution or cash equivalent of a Prize (or Prize component) is permitted. Prizes (and Prize components) are subject to availability and substitution with a Prize of equal or greater retail value if a Prize (or Prize component) is unavailable or cannot be awarded for any reason; at Sponsor's and Sweepstakes administrator's sole discretion. The value of the Prizes set forth above represents Sponsor’s and Sweepstakes administrator’s good faith determination of the ARV thereof and cannot be challenged or appealed. In the event the ARV of a Prize (or Prize component) is more than the actual retail value of the Prize (or Prize component); the difference will not be awarded in cash or otherwise. Prizes and prize notifications will be sent to U.S. addresses only within the forty-eight (48) contiguous states of the U.S. and the District of Columbia. Any depictions of Prizes are for illustrative purposes only. All federal, state, local or other taxes including, without limitation, income taxes are sole responsibility of the winners. Sweepstakes administrator is the not guarantor of the Prizes. Drawing and Notification of Winners: Potential winners will be randomly selected in a drawing held on or about Friday, June 29, 2012 (“Drawing Date”) from among all eligible Entries received by Sweepstakes administrator. Potential winner (if potential prize winner is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian) will be notified by phone and/or e-mail within approximately one (1) week of Drawing Date. Potential winners (if a potential winner is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian) will be notified of his/her winning status at the time s/he receives his/her prize. Prizes and prize notifications will be shipped only to addresses within the forty-eight (48) contiguous states of the U.S. or the District of Columbia. If a potential winner cannot be reached after a reasonable effort has been exerted, if s/he is found to be ineligible, if s/he cannot or does not comply with these Official Rules, or if his/her Prize or prize notification is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected from the remaining eligible Entries, in Sponsor’s sole discretion. Entrants further grant to HANDBAGO & MONDRINA the right to use and publish their name and state online, in print, and in any other media in connection with the sweepstakes. Acceptance of a prize constitutes permission for HANDBAGO & MONDRINA to use winners' names and likenesses, if available, for advertising and promotional purposes without additional compensation unless prohibited by law. General Conditions: Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively “Rules and Laws”). By entering this Sweepstakes, entrants agree to waive any right to claim any ambiguity or error in the Official Rules of the Sweepstakes, or the Sweepstakes itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor and Sweepstakes administrator, whose decisions are binding and final in all respects. Potential winner (if a resident of a jurisdiction that deems winner to be a minor, his/her parent or legal/guardian) will be required to sign, have notarized and return an Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal), and any other documentation that Sweepstakes administrator and/or Sponsor may require (collectively “Affidavit/Release”), within five (5) business days after receipt or potential winner may be disqualified and an alternate potential winner may be selected. If a winner is a resident of a jurisdiction that deems him/her to be a minor, Prize will be awarded in the name of his/her parent/legal guardian, and in the case of the winner must sign the Affidavit/Release on his/her behalf. By accepting a prize (and in the case of the winner returning the completed Affidavit/Release), winners (if a resident of a jurisdiction that deems winner to be a minor, his/her parent or legal/guardian) attest to the authenticity of his/her winning Entry. Notwithstanding anything to the contrary in Sponsor’s privacy policy (located at http://www.handbago.com), except where prohibited by law: (1) entry and/or a winner’s (if a resident of a jurisdiction that deems winner to be minor, his/her parent or legal/guardian) acceptance of a Prize constitutes permission for the Sponsor to use winner’s name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media now known or hereafter devised (including but not limited to posting on a Website), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the Prizes awarded (except if a winner is a resident of TN or wherever prohibited by law) and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of each Entry however Sponsor sees fit and for any purpose without any notice or compensation to entrant or any third parties. Additionally, by opting-in to a specific offer from the Sweepstakes Entities, entrants’ personal information will be subject to the privacy policy and terms of service of the applicable Sweepstakes Entities and entrants agree to receive additional e-mail communication from those Sweepstakes Entities. Any person attempting to defraud or tamper with this Sweepstakes may be subject to prosecution and is not eligible for a Prize. If, for any reason, this Sweepstakes is not capable of running as originally planned, Sponsor in Sponsor’s sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes or any portion(s) thereof and conduct the drawing from among all salvageable eligible Entries received as of the termination date, if any. In case of a dispute over the identity of the entrant who submitted a winning Entry, the owner of the e-mail account will be deemed the entrant, in Sponsor’s sole discretion. Disclaimers: Sweepstakes Entities are not responsible or liable for, and will deem ineligible, multiple Entries submitted using multiple/different e-mail addresses, Entries that are entered by other than human means or mass Entries (such as by an automated computer program or any non-human mechanism, entity, or device), or for Entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By entering Sweepstakes, entrants (their parents/legal guardians if residents of a jurisdiction that deems them to be a minor) agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of the Sponsor and Sweepstakes administrator which are final and binding in all respects to waive any rights to claim ambiguity with the Rules and Laws, and that neither Sponsor nor any Sweepstakes Entities, shall have any responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury, dismemberment or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession, use/misuse, and/or defects of the Prizes awarded herein; cancellations and/or delays or any change by other third party entity or any other persons providing any of the Prizes for the winners due to reasons beyond Sponsor’s and/or Sweepstakes Entities’ control; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access the Sweepstakes, website, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant’s (or any third person’s) computer(s) and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Proof of entering information at website does not constitute proof of delivery or receipt of Entry. By entering, entrants and Prize winners further agree to release, discharge, indemnify and hold harmless the Sponsor and Sweepstakes Entities from and against any and all claims, damages or liability due to any injuries, damages or losses to any person (including but not limited to death or dismemberment) or property of any kind resulting or arising, in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a Prize or participation in this Sweepstakes or any Sweepstakes-related activity or travel, to release all rights to bring any claim, action or proceeding against the Sponsor and/or the Sweepstakes Entities as well as each of their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, promotion partners and/or any entity involved in the development, production, implementation or administration of the Sweepstakes, and each person or entity connected with the production or administration of the Sweepstakes, and each parent company, affiliate, subsidiary, licensee, licensor, agent and representative of any aforementioned entity and each of their respective officers, directors, employees, shareholders, representatives, agents, and any other sponsor that may be announced or otherwise added as a sponsor to the Sweepstakes at any time (collectively "Releasees"), and hereby acknowledge that said Releasees have neither made nor are in any manner responsible or liable for any representation or guarantee, express or implied, in fact or in law, relative to a Prize, including express warranties provided exclusively by any prize supplier or any Sweepstakes Entities that may be sent along with a Prize, its quality, merchantability, fitness for a particular purpose or suitability for use. Releasees shall not be liable to a winner or any other person for failure to supply a Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, threatened terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control. Disputes: Each entrant agrees that any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or the Prizes awarded, shall be resolved individually, without resort to any form of class action, and shall be governed by and construed in accordance with California law, without regard to its conflict of laws provisions. The parties agree that any disputes arising out of this Sweepstakes shall be submitted to final, binding arbitration conducted in Los Angeles County under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. (“JAMS”) before a single, neutral arbitrator who is a former or retired California state or federal court judge with experience in Fashion matters who shall follow California law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Los Angeles County, including an award of costs, fees and expenses incurred in enforcing the award. Any Dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Los Angeles County. Limitation of Liability: In no event will MONDRINA be responsible or liable for any damages or losses of any kind, including without limitation direct, indirect, incidental, consequential, or punitive damages, arising out of any access to and/or use of the sweepstakes site, the downloading from and/or printing material downloaded from the sweepstakes site, the removal from the sweepstakes site of, or discontinuation of access to, any materials, or the acceptance, possession, use, or misuse of, or any harm resulting from the acceptance, possession, use or misuse of, or participation in, any prize awarded in connection with the sweepstakes. Without limiting the foregoing, the sweepstakes, all prizes, and all materials provided on or through the site are provided "as is" without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
